These Terms of Service (“Terms”) govern your use of the PerfumOS mobile application (the “App”), operated by Stonefields AI Labs Limited (“we,” “us,” or “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the App. By using the App, you confirm that you meet this requirement.
2. Your Account
You log in using your email address and password. Password reset ises a one-time passcode sent to your email. You are responsible for keeping access to your email secure and for all activity under your account. Notify us promptly at james@perfumos.app of any unauthorized use.
3. The Service
PerfumOS helps you identify fragrances by photo, explore scent profiles and notes, receive personalized recommendations through our AI assistant (“Ask Whizzy”), build a collection and wishlist, and read and write reviews.
Accuracy disclaimer: Fragrance identification, scent information, and AI-generated recommendations are provided for informational purposes and may not always be accurate or complete. Identification depends on image quality and available data. Do not rely on the App for decisions where accuracy is critical (for example, allergies or sensitivities — always check the physical product’s ingredient list).
4. Free and Pro Tiers
The App offers a free tier with limited usage and a paid subscription (“PerfumOS Pro”) with expanded access. Specific features and limits are described in the App and may change over time. Subscription terms are set out in our Subscription Policy.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose;
- Attempt to access the App through automated means (bots, scripts, scrapers) or circumvent usage limits;
- Reverse engineer, decompile, or interfere with the App or its servers;
- Upload content that is unlawful, infringing, abusive, misleading, or that violates others’ rights;
- Submit fake, spam, or manipulative reviews;
- Resell, redistribute, or exploit the App or its content commercially without our permission.
We may suspend or terminate accounts that violate these Terms or abuse the service (including usage that indicates automated or commercial activity).
6. User Content
You retain ownership of reviews, ratings, and other content you submit (“User Content”). By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute it within the App and for promoting the App. You are responsible for your User Content and confirm you have the right to share it. We may remove content that violates these Terms.
7. Intellectual Property
The App, its design, branding (“PerfumOS,” “Ask Whizzy”), and content (excluding User Content and third-party data) are owned by us or our licensors and protected by intellectual property laws. You may not use our branding without permission.
8. Third-Party Services and Data
The App relies on third-party services (including Apple, Google, OpenAI, RevenueCat) and fragrance data from third-party sources. We do not guarantee the accuracy of third-party data and are not responsible for third-party services.
9. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We do not warrant that the App will be error-free or that identifications and recommendations will be accurate.
10. Limitation of Liability
To the maximum extent permitted by law, Stonefields AI Labs Limited will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the 12 months before the claim.
11. Termination
You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.
12. Changes to These Terms
We may update these Terms. We will post the updated version with a new “Last updated” date and, where appropriate, notify you in the App. Continued use after changes means you accept them.
13. Governing Law
These Terms are governed by the laws of New Zealand, without regard to conflict-of-law principles. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of New Zealand.
14. Apple App Store Additional Terms
If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Stonefields AI Labs Limited only, not Apple, and that Apple is not responsible for the App or its content. Apple is a third-party beneficiary of these Terms and may enforce them. You agree to comply with the Apple Media Services Terms and confirm you are not located in a country subject to a U.S. Government embargo or on a prohibited-parties list.
